Child Support
Child support is designed to ensure that a child’s financial needs are met and that both parents contribute fairly. Whether you are seeking to establish child support, modify an existing order, or enforce unpaid support, having an experienced Texas family law attorney such as Pittman & Henderson, PLLC can help protect your rights and your child’s best interests.
In Texas, child support is governed by the Texas Family Code and is typically calculated using statutory guidelines based on the obligor parent’s net resources and the number of children before the court and the number of children outside of the court’s jurisdiction. For example, if you have one child subject to the proceeding, the current child support calculation in Texas is 20% of the obligor’s net resources. While this may sound like a simple mathematical problem, having an experienced attorney is essential to ensure that all income sources are included and calculated correctly.
While child support guidelines apply in most cases, courts may order non-guideline support when circumstances justify a deviation, such as high income, special needs of a child, or unusual expenses. Pittman & Henderson, PLLC can help you identify whether your case fits the bill.
What if I already have a child support order in place? If there has been a material and substantial change in your, the other parent, or your child’s circumstances, or when the statutory time requirements have been met, our firm can assist you with modification of your current child support order. If these items have not been met, conversely, our firm has also been successful in defending against modification of the support order.
What if my ex is not paying the child support obligation? If the obligor in a child support order stops or fails to pay child support all together, Texas law provides for the parent receiving the child support to bring an enforcement action. Our firm routinely represents clients in enforcements of court orders with remedies being available such as contempt, garnishment, and liens to recover funds owed to the child. We also defend parents facing enforcement claims, helping address arrearages and protect against unjust penalties when circumstances warrant.
Our firm represents parents across Texas in all child support matters, providing practical guidance, clear explanations, and strategic advocacy at every stage of the process.
