What is probate?

Probate is a legal process of winding up a loved-one’s affairs. It involves validating the will, appointing a person responsible to identify and secure the decedent’s assets, to pay any last debts and taxes, and distribute any remaining property to the decedent’s heirs or beneficiaries. This can include a formal, court-supervised process such as an Administration with Letters Testamentary or Letters of Administration or a more simplified, alternative probate process such as probating a Will as a Muniment of Title.


Do I need to probate?

Custodians of assets generally require specific documentation to release or transfer assets to heirs or beneficiaries. What if my loved-one does not have a will?
